Santa Barbara Chapter 7 Bankruptcy Lawyer

Santa Barbara County and Ventura Debt Relief Attorney

If you face overwhelming financial difficulty, a Chapter 7 bankruptcy filing will allow you to permanently discharge some of your debt in exchange for certain assets. Not all debts can be liquidated under Chapter 7, though. In addition, state law allows you to exclude certain assets from the bankruptcy sale. You want an experienced lawyer to take you through the process, someone who has protected the interests of others in similar circumstances.

At the law office of Dennis J. Shea, I have more than 25 years of practice experience, the last 17 as a sole practitioner. When you hire me to help you resolve personal financial problems, you will work directly with me throughout the process. I built my practice through a commitment to personal service and attention, always striving to provide the information and advice you need to make intelligent decisions that protect your future.

I offer a free phone consultation to all clients. To arrange a case evaluation from an experienced Santa Barbara Chapter 7 bankruptcy attorney, contact my office by e-mail or call me at 805-284-9703.

My Chapter 7 Bankruptcy Practice

Under the recent revisions to the bankruptcy laws, you must qualify to file for the discharge of debts under Chapter 7 by submitting to a "means test," where you demonstrate to the bankruptcy court that you lack the means to repay your creditors over a three-to-five-year period. If you fail the means test, your only recourse in personal bankruptcy is under Chapter 13.

When you hire me to help you with a personal bankruptcy filing, I will first determine whether you are eligible for protection under Chapter 7. If so, I will prepare and file all the necessary documents to complete the process. I will also represent you in meetings or hearings with creditors, the bankruptcy trustee or the court.

Before you file, however, I will carefully explain which debts can be discharged, such as credit card bills, medical expenses and certain back taxes, as well as those that may not, including student loans, child support or alimony, and recent taxes. I will also make certain that exempt property, including homes or automobiles, is excluded from the sale.
