My Chapter 7 Bankruptcy Practice
Under the recent revisions to the bankruptcy laws, you must qualify to file for the discharge of debts under Chapter 7 by submitting to a "means test," where you demonstrate to the bankruptcy court that you lack the means to repay your creditors over a three-to-five-year period. If you fail the means test, your only recourse in personal bankruptcy is under Chapter 13.
When you hire me to help you with a personal bankruptcy filing, I will first determine whether you are eligible for protection under Chapter 7. If so, I will prepare and file all the necessary documents to complete the process. I will also represent you in meetings or hearings with creditors, the bankruptcy trustee or the court.
Before you file, however, I will carefully explain which debts can be discharged, such as credit card bills, medical expenses and certain back taxes, as well as those that may not, including student loans, child support or alimony, and recent taxes. I will also make certain that exempt property, including homes or automobiles, is excluded from the sale.
